Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using the web application Superfeedback (the "Service") accessible at https://superfeedback.ai, you agree to be bound by these Terms of Service ("Terms"). These Terms are a legal agreement between you (either an individual or a legal entity you represent, "Customer" or "You") and Superfeedback OÜ, a company registered in Estonia ("Company", "We", "Us"). If you do not agree to these Terms, you must not use the Service.

2. Description of Service

Superfeedback is a B2B SaaS platform that uses Artificial Intelligence (AI) to aggregate and analyze user feedback. The Service may integrate with third-party tools (such as Slack, Jira, and GitHub) to import data for analysis.

3. AI Disclaimer (Important)

• Accuracy of Output: The Service utilizes Large Language Models (LLMs), currently powered by Google Gemini, to generate insights. Artificial Intelligence is probabilistic in nature. You acknowledge that the Service may produce inaccurate, incomplete, or misleading results ("hallucinations").
• No Reliance: You should not rely solely on the Service for critical business decisions. You are responsible for reviewing and verifying all AI-generated output before acting on it. Superfeedback OÜ is not liable for any actions you take based on AI analysis.

4. Accounts and Security

• Registration: You must provide accurate and complete information (Name, Email) to register.
• Security: You are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activities that occur under your account.
• B2B Only: This Service is intended for business use. By registering, you represent that you are using the Service for professional purposes.

5. User Content and Data Ownership

• Your Data: You retain all ownership rights to the text, feedback, and data you upload or import into the Service ("User Content").
• License to Process: By using the Service, you grant Superfeedback OÜ a worldwide, non-exclusive, royalty-free license to access, store, and process your User Content solely for the purpose of providing the Service to you (e.g., generating the feedback analysis).
• No Training on Data: We do not use your proprietary User Content to train our core AI models for the benefit of other customers, unless explicitly agreed upon in a separate agreement.

6. Subscriptions and Payment

• Billing: The Service is billed on a subscription basis ("Subscription"). You will be billed in advance on a recurring and periodic basis (e.g., monthly or annually).
• Payment Processor: All payments are processed by Stripe. We do not store your credit card details.
• Cancellation: You may cancel your Subscription at any time through your account dashboard. Your access will continue until the end of your current billing period.
• Refunds: As a B2B service, payments are generally non-refundable unless required by law.

7. Acceptable Use

You agree not to use the Service to:

• Process Personal Data of third parties without a legal basis (GDPR compliance).
• Upload illegal, harmful, or malicious content.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Interfere with the integrity or performance of the Service (e.g., DDoS attacks).

8. Intellectual Property

The Service, including its original content (excluding User Content), features, code, and functionality, are and will remain the exclusive property of Superfeedback OÜ.

9. Limitation of Liability

To the maximum extent permitted by applicable law (Estonia):

• In no event shall Superfeedback OÜ, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
• Our total liability to you for any claims arising out of or relating to these Terms or the Service is limited to the amount you paid us in the 12 months prior to the event giving rise to the claim.

10. Third-Party Links and Integrations

The Service may contain links to or integrations with third-party websites or services (Slack, Jira, GitHub, Sentry) that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content or practices of any third-party websites. Your use of third-party integrations is governed by the terms of those specific platforms.

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Harju County, Estonia.

13. Changes

We reserve the right to modify these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access the Service after those revisions become effective, you agree to be bound by the revised terms.
